Welcome to Milojee.com. In order for you to use all the services provided within this site, you must be registered as a “Member”. A “Member” will become bound by the terms and conditions of this agreement.
This Agreement sets out the legally binding terms for your membership.
Definitions
Contained in these conditions, the following words have the following meanings unless the context requires otherwise:
"Agreement" means the agreement between ‘You’ and Us incorporating these terms and conditions for the provision of the Service;
“Information” includes without limit all content, software, data, text, photographs, graphics, sound and video;
"Intellectual Property Rights" means all patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights wherever existing in the world together with the right to apply for protection of the same;
"Liability" means the liability of any nature for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses and/or liabilities;
"Member" means any person whose membership has been accepted by Us and whose membership remains valid for the time being;
"Profile" means the section of the Service containing details, photographs and/or other Information about yourself;
"Service" means the service provided by Us to ‘You’ including, but not limited to, Us allowing ‘You’ to browse the Website, contact and/or be contacted by other Members through the Website and/or Post Information on the Website through the use of the chatroom forum and or Milojee Forum;
"User" means any person who browses the Website;
"Website" means Our website at URL www.milojee.com (or such other URL that We may use to provide the Service from time to time);
"You, Your, Yourself" means the person whose application for membership of the Service is accepted by Us.
Eligibility
In order to become a “Member” of Milojee.com, the user must be a minimum age of 18 (eighteen) years old.
This site is not meant to encourage and/or promote illicit sexual relations or extra marital affairs. If Milojee.com discovers or becomes aware that any member is using this site to promote or engage or indulge in illicit sexual relations or extra marital affairs his/her membership will be terminated immediately without any refund and without any liability to Milojee.com. Milojee.com’s discretion to terminate your membership shall be final and binding.
You have NOT been convicted of any offence relating to violence and/or any offence under the Protection from Harassment Act 1997 (or under any statutory enactment replacing and/or amending such Act); and/or
You have NOT been subjected to any injunction or any order to pay damages under the Protection from Harassment Act 1997 (or under any statutory enactment replacing and/or amending such Act).
Terms of Contract
We reserve the right to vary these terms and conditions at any time and the updated version will be posted on the terms and conditions page of the Website. Your continued use of milojee.com after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
On discretion, ‘We’ shall have the right to refuse to grant applications for membership and to terminate memberships at any time.
The Agreement between You and Us shall come into effect on Our acceptance of Your application for membership. No application for membership shall be deemed to be accepted by Us until ‘You’ have received confirmation of Your membership from Us by e-mail.
You may terminate your membership at any time, for any reason by informing Milojee.com in writing to terminate your Membership. In the event of you terminating your membership, you will not be entitled to a refund of any unutilised subscription fees.
Other Terms
You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. The only exception to this is if you wish to create a listing of your business, this can be done through the ‘On-line business directory’. You will not transmit any chain letters or junk email to other Milojee.com Members. Although Milojee.com cannot monitor the conduct of its Members on the Milojee.com Site, it is also a violation of this Agreement to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect Milojee.com and/or our Members from any abuse/misuse, Milojee.com reserves the right to restrict the number of communications/profile contacts & responses/emails which a Member may send to other Member(s) in any 24-hour period to a number which Milojee.com deems appropriate in its sole discretion. You will not send any messages to other Members that are obscene, lewd, licentious, and defamatory, promote hatred and/or are racial or abusive in any manner.
Transmission of any such messages shall constitute a breach of this Agreement and Milojee.com shall be entitled to terminate your membership forthwith. Milojee.com reserves the right to screen messages that you may send to other Member(s) and also regulate the number of your chat sessions in its sole discretion.
Unless otherwise stated, Milojee is the owner of all copyright, trademarks and other ‘intellectual property rights’ in this ‘website’ or has a valid right to use such copyright, trademarks and other intellectual property rights in this site. This includes without limitation all intellectual property rights in respect of all text, graphics, logos, images and any downloads that may be offered on this website. You will not assist or facilitate any third party to, copy, reproduce, transmit, distribute, frame, commercially exploit or create derivative works of such material or content.
Content posted on Site
You understand and agree that Milojee.com may delete any content, messages, photos or profiles that in the sole judgment of Milojee.com violates this Agreement or which might be offensive, illegal, defamatory, obscene, libelous, or that might violate the rights, harm, or threaten the safety of other Milojee.com Members. Milojee has the right in its sole discretion to either forthwith terminate your membership without refund of your subscription fees or delete such objectionable, illegal or unlawful information, material or content from your profile and allow you to continue as a Member.
Pricing and Payment
The price of the Service and any variations shall be as shown on Our FAQ page on the Website from time to time.
You shall pay all sums due to Us under this Agreement by the means of the payment specified in Our Website and without any deduction, counterclaim and/or any other withholding of monies.
Payment shall not be deemed to be made until We have received either cash or cleared funds in respect of the full amount outstanding.
Unless otherwise stated in this Agreement, all monies paid by You to Us are non-refundable.
You will not be able to contact other Members or read and reply to other Members' messages or use the full capabilities of the site until We have received full payment.
The FREE 3 month special offer initially applied during the following selected period, 18th Sept 06 – 18th Dec 06 for all new members registering on Milojee.com. The FREE offer has now been extended to 18th Sep 10.
We reserve the right to terminate or modify any special offer at our sole discretion and/or we reserve the right to change prices listed without notice.
MEMBER'S OBLIGATION (Content in Profile)
As a member of this site, you will not;

Publish any personal details such as your telephone number, fax number, URL or any other information that enables other Members and/or users to contact You directly.

Publish any information that promotes another website, service and or business in any way shape or form including not limiting information telephone number, fax number, URL in your Profile.

Misuse in any way the Service or any Information Posted on the Service;

Post any junk mail, spam, chain letters, pyramid schemes or any similar or fraudulent schemes or any inappropriate form of solicitation; or collection of the responses to any such schemes or solicitation;

In any way assign, transfer, part with and/or authorise any other person to use your membership;

Post any Information, which in Our opinion is sexually explicit, vulgar, indecent, racist, abusive, invasive of another’s privacy, offensive, harmful, threatening, harassing, stalking, inflammatory, sexually suggestive, defamatory and/or obscene; and/or
-
Post any Information which in Our opinion is capable of offending others’ political and/or religious beliefs.
Operation of the Service
The Service is provided in its current form and We do not guarantee or warrant that the Service, or any element of the Service will meet Your exact requirements, purpose and/or expectations.
We do not guarantee or warrant that any of the Information provided in or via the Service is accurate or reliable. You rely on it at Your own risk.
Due to the nature of the internet, we do not provide any warranty or guarantee in respect of the Service, results, availability, and/or uninterrupted use of the Service except that We will use Our reasonable endeavours to rectify serious faults as soon as practical though not within any particular timescale.
We reserve the right to suspend the Service without notice for repair, maintenance or other technical reasons.
Disclaimer
Milojee.com is not responsible for any incorrect or inaccurate content posted on the Site or in connection with the Milojee.com Service, whether caused by users visiting the Site, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any user and/or Member of the Milojee.com Service whether online or offline. Milojee.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user and/or Member communications. Milojee.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Milojee.com Site and/or in connection with the Milojee.com Service.
Under no circumstances will Milojee.com be responsible for any loss or damage to any person resulting from anyone's use of the Site or the Service and/or any content posted on the Milojee.com Site or transmitted to Milojee.com Members.
Any links to third-party websites are for your convenience and the inclusion of the link in our Website does not imply any endorsement, guarantee, warranty or representation by Milojee of the quality or accuracy of the information, products or services provided to you on those third-party websites.
Milojee Forum Rules
You agree to use Milojee.com (including chat-rooms) in accordance with the following Rules.
About your posts:

No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.

No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.

If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your account.

Be patient: users of all ages and abilities may be taking part in the relevant Forum / Chat-room discussions.

No spamming or off-topic material: we don’t allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.

Deliberate misuse of the complaints facility is not permitted. If you persist in doing this action may be taken against your account.
Terms and Conditions (Events pages)
Any information contained on the Events page has been provided by the promoter of the actual advertised event. Reasonable effort is exercised by Milojee to substantiate that the advertised event does not breach our stated terms and conditions. Milojee does not take responsibility for any false information provided by external parties.
We reserve the right to reject posting an event if we deem the event or content supplied conflicts with our terms and conditions.
The events sections may contain links to other websites operated by external parties. The content of such third-party websites to which you may link, by means of hypertext links, from our Website is beyond our control.
We reserve the right to terminate or modify any special offer at our sole discretion and/or we reserve the right to change prices listed without notice.
Terms and Conditions (On-Line Directory)
Any business listing contained on the directory is valid for the duration of 1 (one) calendar year from the date of posting onto Milojee. The full fee must be payable before posted on the site.
Any proposed business listing will be verified and subject to approval before listing is advertised on the site. If a listing is rejected, you will be notified by Milojee. Any decisions made by Milojee is considered final and no correspondence entered into.
